You have basically answered your question yourself. That's the relevant part of the usage policy you have to adhere to. Please be aware that the 1 request/s limit is for the sum of requests made by the users of your application/website. If you have already set a custom user agent and still find yourself blocked, then it is likely that you have hit that limit and need to find a way to reduce the number of requests or use a different geocoding solution.

If you are using the API in a commercial setting, please consider switching to a commercial provider (some are listed at
https://wiki.openstreetmap.org/wiki/Nominatim#Alternatives_.2F_Third-party_providers) or setting up your own instance of Nominatim.
